1. Acceptance of Terms
By accessing or using the website and services of Take A Chance Transport, including any form submissions or service requests, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site or request services.
Take A Chance Transport may update these Terms at any time. Continued use of the Site or use of our towing and transport services after any changes constitutes acceptance of the revised Terms.
2. Use of the Site and Services
You agree to use this Site and our services only for lawful purposes and in a manner that does not infringe the rights of others or interfere with safe operations. You may not:
- Use the Site or services to transmit unlawful, abusive, or misleading communications
- Provide false vehicle, pickup, location, or contact information
- Attempt to gain unauthorized access to any part of the Site or service records
- Interfere with dispatch, towing, loading, transport, or vehicle release procedures
3. Service Requests, Dispatch, and Vehicle Handling
Service availability, estimated arrival times, and pricing are subject to traffic, weather, road conditions, vehicle type, access conditions, and dispatch availability. The customer is responsible for providing accurate pickup and drop-off details, vehicle condition information, and any special instructions needed for safe towing or transport.
3.1 Customer Responsibility
You must ensure the vehicle is legally accessible for towing or transport and that you have the authority to request service. Any personal property left in the vehicle should be removed before service whenever possible. Take A Chance Transport is not responsible for items left inside a vehicle unless otherwise agreed in writing.
3.2 Payment Terms
Payment is due when service is completed unless other arrangements are agreed in advance. Additional charges may apply for winching, off-road recovery, after-hours service, long-distance transport, specialty vehicles, waiting time, or circumstances requiring extra equipment or labor.
3.3 Cancellations and Refusals
If a service call is canceled after dispatch or if service cannot be safely completed due to incorrect information, unsafe conditions, or lack of access, a cancellation or trip fee may still apply.
4. Damage, Liability, and Limitations
Take A Chance Transport uses reasonable care when providing towing and transport services. However, certain risks are inherent in vehicle recovery, towing, and loading. We are not liable for pre-existing damage, mechanical failure, tire or suspension issues, undercarriage damage caused by pre-existing conditions, or loss resulting from inaccurate information provided by the customer. To the fullest extent permitted by law, our liability is limited to the cost of the specific service provided.
5. Vehicle Contents and Personal Property
Customers are responsible for securing or removing valuable personal property before towing or transport. We do not guarantee the condition, security, or recovery of items left inside the vehicle, and we are not responsible for loss or damage to personal belongings unless required by law.
6. Warranties and Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TAKE A CHANCE TRANSPORT DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY ESTIMATE WILL BE EXACT.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TAKE A CHANCE TRANSPORT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR OUR SERVICES, INCLUDING BUT NOT LIMITED TO DELAYS CAUSED BY TRAFFIC, WEATHER, ROAD CONDITIONS, CARRIER ISSUES, OR EVENTS BEYOND OUR CONTROL.
8. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions.
